New Liability Files
o Determine liability, if not already determined
o Order investigative tools when needed to determine liability
o Deny claims when appropriate
o Approve liability when evidence for named insured is irrefutable
o Review of coverage for Driver Not On Policy and Vehicle Not On Policy
o Prepare Reservation of Rights (RORs) under no coverage provisions when applicable
o Have RORs delivered when approved
o Work with Plaintiff’s Counsel when presented with Letters of Representation and Preservation of Evidence Notices (POE)
o Present Named Insured with any such POE notices
o Preserve and work calendar
o Enter claim data into ISO
Demand Management
o Receipt and acknowledge all demands received from Plaintiff’s Counsel
o Order investigative actions to aid in assessment of demand presented
o Prepare and submit Large Loss Reports for reserve and settlement authority
o Receipt reserve and settlement authority granted
o Settle claims when possible
Litigated Files
o Assign defense counsel to file pending conflict checks
o Order investigative actions to aid in suit if not already ordered
o Prepare and submit Large Loss Reports for reserve and settlement authority
o Receipt reserve and settlement authority granted
o Prepare updates as needed
o When appropriate, use investigative data to initiate negotiations to settle ahead of mediation
o Work with Defense Counsel to get cases to mediation
o Aid Defense Counsel to settle claims and avoid trial
o Prepare carrier for trial when unavoidable
Mediation
o Order investigative actions to aid in suit if not already ordered
o Prepare and submit Large Loss Reports for reserve and settlement authority
o Receipt reserve and settlement authority granted
o Work with Defense Counsel to settle claim at mediation
